Welcome to HSTR.pro (“HSTR Cloud”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our website (hstr.pro), our client area (client.hstr.pro), and all related web hosting and consulting services (collectively, the “Services”).

By accessing or using our Services, you (“User”, “Client”, “you”) agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

1. Description of Services

HSTR.pro provides the following services:

• Free Developer Plan: A shared web hosting service provided free of charge, subject to the resource limitations and policies outlined in these Terms.
• Paid Shared Hosting Plans (e.g., “Pro Plan”): Paid shared hosting services that may be offered in the future, which will be subject to these terms and specific pricing agreements.
• VPS Setup Service: A one-time, paid consulting service where we provide guidance to help you acquire a Virtual Private Server (VPS) from a third-party provider.

2. Account Eligibility

You must be at least 18 years of age to use our Services. By creating an account, you represent and warrant that you are of legal age and that all registration information you submit is accurate and truthful. You are responsible for maintaining the security of your account password.

3. Acceptable Use Policy (AUP)

Your use of our Services is subject to this Acceptable Use Policy. Any violation of this AUP may result in the immediate suspension or termination of your account without notice.

You agree NOT to use the Services for any of the following prohibited activities:

• Illegal Activities: Hosting, distributing, or linking to any content that is illegal under the laws of [Your Country/State] or international law. This includes, but is not limited to, copyrighted material you do not own, fraudulent schemes, and child pornography.
• System Abuse: Engaging in any activity that disrupts or interferes with our servers or network. This includes, but is not limited to:
  • CPU/Cryptocurrency Mining.
  • Running public proxies (e.g., VPNs, TOR relays).
  • File sharing or peer-to-peer (P2P) activities, including BitTorrent.
  • Mail bombing, spamming, or sending any form of unsolicited bulk email.
  • Running cron jobs with intervals of less than 15 minutes.
• Malicious Content: Hosting or distributing malware, viruses, phishing pages, or any other code intended to harm or steal data from others.
• Hate Speech & Harassment: Hosting content that is threatening, abusive, harassing, defamatory, or promotes violence or discrimination against any individual or group.

4. Resource Usage

All accounts are subject to the resource limits (e.g., disk space, bandwidth, CPU) of their chosen plan. Exceeding these limits will result in the temporary suspension of your website until the issue is resolved or the billing cycle resets. We reserve the right to suspend any account that is found to be consuming an excessive amount of server resources, thereby impacting other users.

5. Backups and Data Loss

While our servers may have their own internal backups for administrative purposes, you are solely responsible for creating and maintaining your own backups. We provide tools within the Plesk control panel to assist you with this. HSTR.pro will not be held liable for any data loss, for any reason.

6. Service Term and Termination

• Free Developer Plan: The Free Developer Plan is provided on a 365-day term. The service will be automatically terminated after 365 days unless renewed by you (for free) prior to expiration.
• Termination by Us: We reserve the right to suspend or terminate any account at any time, for any reason, without prior notice, especially for violations of our Acceptable Use Policy.
• Abandoned Accounts: Accounts on the Free Developer Plan that show no activity (e.g., website traffic, logins) for a period of 90 days may be considered abandoned and terminated to free up server resources.

7. Specific Terms for VPS Setup Service

Our “VPS Setup Service” is a one-time consulting and guidance service only. By purchasing this service, you understand and agree to the following:

• Third-Party Relationship: We are guiding you to purchase a service directly from a third-party provider. Your account, billing, and legal relationship will be with that provider, not with HSTR.pro.
• No Guarantees: We do not own or manage the third-party provider. We are not responsible for their uptime, performance, support, pricing, or terms of service. The availability of any promotional pricing or discounts from the third-party provider is not guaranteed and can be changed or revoked by them at any time.
• Your Responsibility: You are solely responsible for all payments to the third-party provider and for adhering to their Terms of Service.
• Nature of Fee: The fee paid to HSTR.pro is solely for our time, knowledge, and step-by-step guidance to help you complete the setup process. This fee is non-refundable once our guidance has been provided.

8. Disclaimer of Warranties

The Services are provided on an “as-is” and “as-available” basis. HSTR.pro makes no warranties of any kind, express or implied, including but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.

9. Limitation of Liability

To the maximum extent permitted by law, HSTR.pro shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use or inability to use the Service.

In no event shall HSTR.pro’s total liability to you for all damages exceed the amount you have paid to HSTR.pro in the last six (6) months.

10. Modification of Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this site. You are advised to review these Terms periodically for any changes. Your continued use of the Service after such changes constitutes your consent to such changes.

11. Governing Law

These Terms shall be governed by the laws of Democratic Republic of Bharat (india), without regard to its conflict of law provisions.
